The opposition upnd to appeal in the supreme court the decison by the lusaka high court to nullify the mufumbwe election results

THE OPPOSITION UNITED PARTY FOR NATIONAL DEVELOPMENT HAS INDICATED THAT IT WILL STILL PROCEED WITH AN APPEAL IN THE SUPREME COURT DESPITE THE DECISION BY THE LUSAKA HIGH COURT TO DISMISS ITS APPEAL TO STAY THE DECISION TO NULLIFY THE MUFUMBWE ELECTION RESULTS.
THE LUSAKA HIGH COURT YESTERDAY THREW OUT AN APPEAL BY THE FORMER MUFUMBWE MEMBER OF PARLIAMENT ELLIOT KAMONDO, IN WHICH HE WAS ASKING THE COURT TO STAY THE DECISION TO NULLIFY THE ELECTION RESULTS OF APRIL THIS YEAR.
THE NULLIFICATION OF THE MUFUMBWE RESULTS FOLLOWED THE VIOLENCE WHICH CHARACTERIZED THE BY-ELECTION IN THE SAME CONSTITUENCY WHERE SEVERAL VOTERS WERE MAIMED DURING THE CAMPAIGN PERIOD.
JUDGE PHILIP MUSONDA HAS SINCE SAID THE ELECTORAL COMMISSION OF ZAMBIA SHOULD GO AHEAD AND SET THE DATE FOR THE BY-ELECTION STATING THAT THERE WAS NO LIKELIHOOD THAT THE APPEAL WOULD SUCCEED.
BUT IN AN INTERVIEW WITH RADIO PHOENIX UPND SPOKESPERSON CHARLES KAKOMA EXPRESSED SHOCK AT THE MANNER THE COUNTRY’S JUDICIAL SYSTEM IS OPERATING CHARGING THERE IS NO WAY ONE COUNTRY CAN HAVE TWO LEGAL SYSTEMS IN PLACE.

ASKED IF IN HIS VIEW HE THINKS THE COUNTRY HAS TWO PARALLEL LEGAL SYSTEMS, MR KAKOMA OPTED TO QUESTION THE MANNER IN WHICH COURTS ARE HANDLING CASES INVOLVING THE OPPOSITION IN THE COUNTRY AND CITED THEIR PENDING CASE WITH THE NAMWALA AREA MEMBER OF PARLIAMENT MAJOR ROBBY CHIZYUKA WHICH IS IN THE COURTS OF LAW.ENDS////
