THE REVENUE APPEALS TRIBUNAL HAS DISMISSED AN APPEAL BY CELTEL ZAMBIA PLC NOW ZAIN ZAMBIA RELATING TO A CLAIM FOR REFUND OF EXCISE DUTY THEY BELIEVED WAS ERRONEOUSLY LEVIED ON THEM BY THE ZAMBIA REVENUE AUTHORITY.
ACCORDING TO A STATEMENT RELEASED TO RADIO PHOENIX BY ZRA COMMUNICATION OFFICE, THIS IS WAS IN A MATTER BEFORE THE TRIBUNAL COMPRISING VICE CHAIRMAN DR NGOSA SIMBYAKULA, MARIAN MUNYINDA AND STEPHEN LUNGU WHERE CELTEL ZAMBIA PLC TRADING AS ZAIN ZAMBIA APPEALED AGAINST A DECISION BY ZRA TO DISALLOW A CLAIM FOR REFUND OF EXERCISE DUTY THAT THE MOBILE FIRM BELIEVED WAS ERRONEOUSLY LEVIED ON THEM.
ACCORDING TO THE STATEMENT, ALTHOUGH THE TRIBUNAL AGREED WITH ZRA THAT CELTEL ZAMBIA PLC COULD NOT BE REFUNDED THE EXERCISE DUTY, IT ORDERED THAT CELTEL ZAMBIA AND ZRA TOGETHER WITH THE INVOLVEMENT OF THE ZAMBIA INFORMATION AND COMMUNICATIONS TECHNOLOGY AUTHORITY FIND MODALITIES OF HOW CONSUMERS COULD BE COMPENSATED FOR THEIR TAX WHICH WAS ERRONEOUSLY LEVIED AND COLLECTED FROM THEM FROM 2004 TO 2008.
